1. Agreement to These Terms
These Terms & Conditions ("Terms") form a binding agreement between you and Home Renovation Trick ("Apex", "we", "us"), a renovation company with offices at 363 Great Rd, Bedford, Massachusetts 01730, USA. By accessing homerenovationtrick.com, submitting any form on the website, or engaging our services, you agree to these Terms. If you do not agree, please do not use the site.
2. Definitions
- "Website" — homerenovationtrick.com and all subpages.
- "Services" — renovation management and construction services, including plumbing, electrical, HVAC, siding, roofing and window work.
- "Proposal" — a written, fixed-price scope document issued after assessment.
- "Contract" — a signed Proposal together with Apex's standard project contract and change-order forms.
3. Website Use & Eligibility
- You must be at least 18 years old to submit forms or request Services.
- You agree to provide accurate, current and complete information in all enquiries and bookings.
- You may not use the Website for unlawful purposes, to transmit malware, to scrape content at scale, or to interfere with its operation.
- Submitting false enquiries, or using the forms to solicit or advertise to us, is prohibited.
4. Estimates, Quotations & Pricing
- Package prices shown on the Website (e.g., "from $12,800", "from $38,500", "from $96,000") are starting indications only and are not offers.
- A binding price is issued exclusively in a written fixed-price Proposal following a free consultation and in-home or remote assessment.
- Proposals are valid for 30 days unless otherwise stated, and may be revised if site conditions, permit requirements or written scope changes materially differ from what was assessed.
- Any change to an agreed scope is performed only under a signed written change order stating its price and schedule impact.
5. Project Contracts, Scheduling & Access
- Work begins only after a signed Contract and any required deposit are received.
- Start and completion dates are stated in your Contract. While 96% of our projects finish on schedule, dates may be adjusted for events beyond reasonable control (see Section 10), and we will notify you promptly in writing.
- You agree to provide safe, reasonable access to the property during agreed working hours (Monday–Saturday, 8:00 AM–7:00 PM local time), functioning utilities where needed, and a place for materials to be stored securely.
- You confirm you own the property or hold the owner's authority to renovate it.
6. Permits, Codes & Licensing
Unless your Contract states otherwise, Apex files all required building permits, coordinates inspections and ensures work complies with applicable building, electrical, plumbing, mechanical and energy codes in your jurisdiction. Licensing details for your state are provided in your Proposal upon request.
7. Payments & Financing
- Payment schedules (deposit, milestone and completion payments) are defined in your Contract.
- Late payments may accrue interest at the lower of 1.5% per month or the maximum permitted by law, and Apex may lawfully suspend work after written notice.
- Financing, where offered, is provided by independent third-party lenders. Apex does not decide credit approvals and is not the lender. Loan terms are solely between you and the lender.
8. Workmanship Warranty
- Projects include Apex's transferable 12-year workmanship warranty (5 years on Refresh-package scopes, unless upgraded), covering defects in our installation for the trades we performed.
- Manufacturer warranties on materials and appliances are passed through to you; we will reasonably assist with claims.
- The warranty excludes ordinary wear and tear, damage from misuse, neglect, alterations by others, natural disasters, and work performed by third parties not engaged by Apex.
- Warranty claims should be submitted to info@homerenovationtrick.com with photographs; we respond within 5 business days and remedy covered defects at no cost.
9. Cancellation & Termination
- You may cancel a booked consultation at any time at no charge.
- After a Contract is signed, cancellation rights, refundable amounts and notice periods are those stated in the Contract, consistent with applicable state home-improvement and right-of-rescission laws.
- Either party may terminate for material breach that remains uncured 15 days after written notice.
10. Force Majeure
Apex is not liable for delays or failures caused by events beyond reasonable control, including severe weather, natural disasters, fires, pandemics, labor disputes, supply-chain failures by manufacturers, or governmental actions. Affected timelines will be equitably adjusted and communicated in writing.
11. Intellectual Property
- All Website content — text, design, photography, logos, 3D renders and code — is owned by Apex or its licensors and protected by U.S. copyright and trademark law.
- You receive a limited, revocable license to view the Website for personal, non-commercial purposes. Copying, republishing or creating derivative works without written permission is prohibited.
- Design concepts, 3D models and drawings prepared for you remain Apex property until final project payment; upon payment, you receive a perpetual license to use them for your property.
12. User Content
If you send us photographs, plans or descriptions of your home, you grant Apex a non-exclusive license to use them solely to deliver, document and — with your separate written approval — promote the project. We will never publish identifiable photos of your home without permission.
13. Website Disclaimers
- The Website is provided "as is" without warranties of any kind, express or implied.
- Articles, FAQs and guides are general information, not professional construction, legal, financial or tax advice for your specific property.
- Photographs on the Website may depict representative completed projects; results vary by property, scope and jurisdiction.
14. Limitation of Liability
To the maximum extent permitted by law, Apex's total liability arising from the Website or any pre-contractual dealings is limited to $100. Liability arising from construction Services is governed exclusively by your signed Contract and applicable state construction statutes. Neither party is liable to the other for indirect, incidental, special, consequential or punitive damages.
15. Indemnification
You agree to indemnify Apex against claims arising from information you provided that was false or misleading, your misuse of the Website, or your breach of these Terms.
16. Dispute Resolution & Governing Law
- These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules.
- Before filing suit, both parties agree to attempt good-faith resolution through a documented 30-day negotiation, followed by non-binding mediation if needed.
- Subject to the arbitration provisions (if any) in your project Contract, disputes are brought in the state or federal courts located in Middlesex County, Massachusetts.
17. Communications Consent
By submitting a form, you consent to receive calls, texts and emails from Apex about your enquiry at the contact details provided, consistent with our Privacy Policy. Marketing emails always include a one-click unsubscribe; call/text preferences can be changed any time by contacting us.
18. Miscellaneous
- If any provision of these Terms is held unenforceable, the remainder stays in force.
- Our failure to enforce a right is not a waiver of it.
- These Terms, together with any signed Contract, are the entire agreement regarding the Website and Services.
- We may update these Terms; the "last updated" date reflects the current version, and continued use constitutes acceptance.
